You will be given a quotation for the legal fees. The quotation will also cover any third-party expenses (“disbursements”) payable on your behalf such as HM Land Registry fees etc.

Once you are happy with the legal costs a file will be opened and you will be provided with a client care letter which states who will be dealing with your case and an explanation of the process and costs. Once you have returned the initial documentation, your legal advisor will issue the Contract of Sale to the buyer’s solicitor and the legal due diligence and investigation process will begin.

When the buyer’s legal due diligence and investigations are concluded, and the sale is ready to progress, we will advise you when we are in a position to exchange contracts. 

Following legal and physical completion, we will deal with post completion work such as final completion letters to your buyer’s solicitors and monitoring the discharge of any mortgages and secured debts.

Key Stages Purchase:

Once your funding arrangements are finalised, then you are in a comfortable position to make your own offer on your newly chosen property to purchase. Once an offer is accepted, it’s time to instruct solicitors.

You will be given a quotation for the legal fees. The quotation will also cover any third-party expenses (“disbursements”) payable on your behalf such as HM Land Registry fees, Stamp Duty Land Tax etc.

Once you are happy with the legal costs a file will be opened and you will be provided with a client care letter which states who will be dealing with your case and an explanation of the process and costs. Once you have returned the initial documentation, your legal advisor will request the Contract of Sale from the seller’s solicitor and the legal due diligence and investigation process will begin.

When the legal due diligence and investigations are concluded, and the purchase is ready to progress, we will advise you when we are in a position to exchange contracts. Upon your agreement to do so we would exchange contracts which ensures everyone is committed to the purchase. 

Following legal and physical completion, we will deal with post completion work such as final completion letters to your seller’s solicitors, and ensuring the new property is duly registered at the Land Registry into your ownership, as well as any Stamp Duty Land Tax issues where applicable.

Once the new property is registered at the Land Registry in your name, we will contact you to confirm this and provide you with proof of your legal ownership.

Timescales

Timescales for either buying or selling are often complicated due to chains involved and dealing with various third parties such as estate agents, other sellers and buyers, other law firms, search providers and the land registry. However, a simple transaction with no complications and chain will generally take around 16 weeks. 

Please be aware that where there is a long chain your completion depends on a long line of transactions and everyone having the same timescales in mind.

If there is a property in probate within your chain this can delay matters until the probate is complete.

If there is an issue with searches or the official registration of land can add additional time and costs to review and work with you or the seller to resolve.

Issues with planning permission.

Incorrect information on mortgage applications, for you or anyone in your chain can hold up transactions for weeks as often the mortgage application needs to be resubmitted.

This can be a difficult and stressful time in your life and will possibly be the biggest purchase you ever make, and our best advice is to be realistic and allow yourself freedom and flexibility on your moving date.

Pricing

It is not possible to give precise costs figures without first understanding your specific transaction and your exact requirements. Our basic fees for a sale or purchase range from £690 including vat of £115 to £1198.80 including vat of £199.80. Our fee for remortgages is £420 including vat of £70.

Our fees include items detailed in the calculator above, however there may be factors which would typically increase the cost of the fees. Where there is likely to be any additional cost, we will make sure you are informed of this at the earliest opportunity and a clear estimate of those extra costs will be provided. We also provide a menu of additional services which highlights additional costs which may be relevant to your matter.

Additional fees may include any additional work required for Help-to-Buy ISA's, Deed of Covenant, Statutory Declaration, Transfers of Equity, New Build Fee, gifted deposits.
